Main Customs Clearance Methods
Core Meaning: The seller (exporter) bears all risks, responsibilities, and costs, including transportation, import clearance, and payment of all duties, VAT, and consumption taxes, up to the point of delivering the goods to the buyer’s (importer’s) specified location. Applicable Scenarios: • Buyers who prefer a “one-stop” service and wish to avoid any involvement in the clearance process (common in B2C e-commerce and personal shipments). • Sellers who have a branch office or a qualified agent in the importing country capable of handling tax matters. Considerations: • For the seller, this method carries the highest risk. Accurate estimation of destination port duties and operational costs is critical. • In some countries (e.g., the U.S.), if the seller does not have a physical presence locally, the law may not permit clearance to be conducted in the seller’s name, necessitating the use of an agent.
Core Meaning: The seller is responsible for transporting the goods to the named place of destination but does not bear the costs or handle the formalities for import clearance. The buyer is responsible for clearance and the payment of duties. Current Status: In the latest Incoterms 2020, the DDU term was officially removed and replaced by DPU (Delivered at Place Unloaded). However, “DDU” remains widely used in commercial practice, often referring to “clearance excluding duty/tax payment.” Applicable Scenarios: • Buyers have the capability or channels to handle local clearance themselves. • Duties cannot be accurately estimated in advance (e.g., for auctions, samples). Risk Points: Upon arrival at the destination port, if the buyer delays clearance, high demurrage and detention charges can accrue. In extreme cases, the goods may be auctioned by customs, leaving the seller at risk of losing both the goods and payment.
Core Meaning: This is the standard term under Incoterms 2020, essentially an upgraded version of DDU. The seller arranges carriage and delivers the goods to a named place (often the buyer’s premises or warehouse) but does not handle import clearance or pay import duties. • Difference from DDU: DAP provides greater clarity on the responsibility for unloading. Typically, the seller is responsible for transport to the agreed point but is not obliged to unload. If unloading is required, the term DPU should be used. • Applicable Scenarios: Door-to-door transport services where the seller arranges carriage to the buyer’s location, but clearance is handled by the buyer or consignee.
Core Meaning: The consignee (importer) uses their own customs license to declare the goods directly to their local customs authority. Applicable Scenarios: • Large manufacturers importing raw materials, or large retailers importing goods. • When using courier services for high-value shipments requiring formal entry. Advantages: Lowest cost (no broker fees) and best confidentiality of commercial data. Challenges: Requires the consignee to have import/export rights, a thorough understanding of local tariff classification, and familiarity with the customs declaration process.
Core Meaning: The consignee authorizes a licensed customs broker or freight forwarder to file the declaration, either in the broker’s name or on behalf of the consignee. Applicable Scenarios: • Small and medium-sized enterprises without dedicated in-house customs departments. • Complex shipments involving special requirements (e.g., goods requiring licenses, inspection, or quarantine). Note: Even when a broker is hired, the legal entity responsible for duty payment remains the consignee (importer).
Core Meaning: Goods are transported via international couriers (e.g., DHL, FedEx, UPS, EMS). The courier acts as the declarant, using a simplified, informal entry process. Applicable Scenarios: Samples, personal effects, cross-border e-commerce parcels (small packages). Characteristics: • Shipment value is typically below the importing country’s de minimis threshold (e.g., $800 USD for the U.S., €150 for the EU). • The process is simple and fast. However, if customs examines the shipment and deems it requires a formal entry, the courier will notify the consignee to switch to a formal brokerage clearance process.
